These Terms of Use ("Terms") govern your use of the Calobite mobile application ("Calobite", "the app", "we", "our"). By downloading, installing, or using Calobite, you agree to these Terms. If you do not agree, do not use the app.
1. License
Calobite grants you a limited, non-exclusive, non-transferable, revocable license to use the app for your personal, non-commercial purposes, subject to these Terms.
When you install Calobite from the Apple App Store, your use is also governed by Apple's Standard End User License Agreement ("Apple Standard EULA"). When you install Calobite from the Google Play Store, your use is also governed by the Google Play Terms of Service.
2. Subscriptions
Plans and Pricing
Calobite Premium is offered as a recurring, auto-renewing subscription in two plans:
- Monthly: US$9.99/month.
- Yearly: US$69.99/year after a 3-day free trial for eligible new subscribers.
Prices may vary by region, currency, and store promotions. The price shown at the point of purchase in the app is authoritative and includes applicable taxes where required. We may change subscription prices from time to time; any change will take effect at the start of your next billing period and, where required by law, only after advance notice.
Auto-Renewal
Your subscription automatically renews at the end of each billing period unless canceled at least 24 hours before the period ends. Payment is charged to your Apple ID or Google Play account at confirmation of purchase and at each renewal.
Free Trial
If you start a free trial, you will not be charged during the trial period. If you do not cancel at least 24 hours before the trial ends, your subscription will automatically convert to a paid subscription and you will be charged the full price. Any unused portion of a free trial is forfeited when you purchase a subscription.
Cancellation
You can cancel your subscription at any time through your device's subscription settings:
- iOS: Settings → your Apple ID → Subscriptions → Calobite → Cancel Subscription.
- Android: Play Store → Profile → Payments & subscriptions → Subscriptions → Calobite → Cancel.
Cancellation takes effect at the end of the current billing period. You will retain access to Premium features until that date. We do not offer pro-rated refunds for unused time.
Refunds
All subscription purchases are handled by Apple (App Store) or Google (Play Store) and are subject to their respective refund policies. We cannot issue refunds directly. To request a refund, use Apple's Report a Problem portal or Google Play's refund request process.
3. Promotional Codes
We may issue promotional codes for reviewers, testers, or marketing partners. Promotional codes are non-transferable, have no cash value, and are valid only for the use case described at the time of issuance. We may deactivate a promotional code before it is redeemed, or after redemption only in cases of fraud, abuse, or error.
4. Your Account
You may use Calobite with a Google account, Apple ID, or anonymously. You are responsible for any activity that occurs under your account and for keeping your device secure.
You can delete your account and all associated data at any time from within the app (Profile → Delete Account). Deletion is permanent and irreversible. Some records required for legal, tax, or fraud prevention purposes may be retained after deletion, as described in our Privacy Policy.
5. Acceptable Use
You agree not to:
- Reverse engineer, decompile, or attempt to extract source code from the app, except where explicitly permitted by law.
- Use the app to violate any law or third-party rights.
- Attempt to bypass, disable, or interfere with security or billing features.
- Use the app's AI scanning features to submit content that is not food or a food label, or that you do not have the right to share.
- Scrape, re-sell, or redistribute the app's content, data, or services without our written permission.
6. Health and Nutrition Disclaimer
Calobite is a fitness and wellness tool. It is not a medical device and does not provide medical, nutritional, or dietary advice. Calorie and macro estimates (including AI-generated estimates) are approximations and may be inaccurate. Calobite is not a substitute for professional medical advice, diagnosis, or treatment.
Do not use Calobite to make medical decisions or in place of advice from a licensed clinician. Always consult a qualified healthcare professional before making significant changes to your diet, exercise routine, or health regimen — particularly if you are pregnant, breastfeeding, have a medical condition, are taking medication, or have a history of eating disorders.
If you believe you may have an eating disorder or that tracking calories is harming your mental or physical health, please seek help. In the US, the National Eating Disorders Association (NEDA) helpline is 1-800-931-2237 or text "NEDA" to 741741.
7. AI Features
Calobite uses third-party AI services to identify foods and estimate nutrition from photos you submit. AI estimates can be inaccurate by approximately 20% or more, and should be treated as a starting point rather than a precise measurement. Review and edit any AI-generated entries before relying on them. See our Privacy Policy for details on how photos are processed.
8. Intellectual Property
Calobite and all associated trademarks, logos, designs, text, graphics, and software are the property of Calobite or its licensors and are protected by copyright and other intellectual property laws. These Terms do not grant you any rights to our trademarks or trade dress.
9. User Content
Any data you enter into Calobite (meal entries, weight entries, photos, notes) remains your property. You grant us a limited license to store, process, and display that content solely to provide you the service. We do not claim ownership of your personal data.
10. Third-Party Services
Calobite integrates with third-party services, including Apple, Google, Supabase, RevenueCat, Superwall, PostHog, Open Food Facts, USDA, OpenAI, and Google Gemini. Your use of the app is subject to the terms and privacy policies of those services where applicable. We are not responsible for the content, availability, or practices of third-party services.
11. Changes to the App
We may update, change, or discontinue features at any time. We may also update these Terms. If changes are material, we will notify you in-app or by posting an updated version on this page with a new "Last updated" date. Continued use of the app after changes take effect constitutes acceptance of the updated Terms.
12. Termination
We may suspend or terminate your access to the app if you breach these Terms or engage in fraud, abuse, or activity that harms other users or the service. You may stop using the app and delete your account at any time.
13. Warranty Disclaimer
The app is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the app will be uninterrupted, error-free, or secure.
14. Limitation of Liability
To the maximum extent permitted by applicable law, Calobite and its affiliates, contractors, and licensors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill, arising out of or in connection with your use of the app.
Our total aggregate liability to you for any claim arising from the app will not exceed the amount you paid us in the twelve months preceding the claim.
Nothing in these Terms limits or excludes liability for:
- death or personal injury caused by our negligence;
- fraud, fraudulent misrepresentation, or willful misconduct;
- gross negligence;
- any other liability that cannot be limited or excluded under applicable law (including non-waivable consumer rights under the laws of your jurisdiction, such as the EU Consumer Rights Directive, the UK Consumer Rights Act, or the Australian Consumer Law).
15. Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold Calobite harmless from third-party claims, damages, or expenses (including reasonable legal fees) that arise directly from (a) your breach of these Terms, (b) your violation of any law or third-party right, or (c) content or data you submit to the app. This obligation does not apply to matters caused by our own breach, negligence, or willful misconduct, and is limited to what is enforceable under consumer-protection law in your jurisdiction.
16. Governing Law
These Terms are governed by the laws of the Hashemite Kingdom of Jordan, without regard to its conflict-of-law rules. Disputes arising from these Terms or the app may be brought in the competent courts of Amman, Jordan.
Nothing in this section limits mandatory consumer-protection rights or the right to bring proceedings in the courts of your country of residence where required by applicable law. If you are a consumer in the EU, UK, or another jurisdiction with non-waivable protections, those protections apply regardless of this clause.
17. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.
